The existence on the real estate market of properties with illegal constructions in Mallorca has become one of the biggest problems for buyers and sellers.

There are two facts that determine the situation in which we find ourselves.
a) For decades illegal construction has not been pursued. This has favoured its growth.
b) In recent years the administration has decided to put an end to illegal constructions in Mallorca by redoubling its efforts to detect it.

Illegal Constructions in Mallorca are al problem if you ignore them.

Although the seller should inform the buyer of the legal status of the property, he often does not do so.
Firstly because sometimes he does not know. An owner who bought the property years ago and has used it without any problems may be unaware that there are illegalities. Sometimes they know but prefer not to say so as not to lose the sale.
As for the real estate agencies, they are not even experts in town planning and furthermore they only have the information given to them by the seller. Don’t forget that estate agents work for the seller.

Illegalities should not be a problem when buying a house in Mallorca. The problem is BUYING WITHOUT KNOWING WHAT THE REAL STATE OF THE PROPERTY IS. That is why it is essential that a specialist property consultant (lawyer) reviews the whole process.
The consequences of buying a property with problems vary. Many times nothing happens, other times, in the worst scenario, part of the property may have to be demolished.
The Consell de Mallorca (Island Government) through the Agency of Defense of the Territory, extends little by little its staff and functions ordering demolitions.
