Summarizing in the process of buying a home in Mallorca, there are three important parts.
On the one hand, to comply with all the formalities necessary to get the new property registered in the name of the buyer. From obtaining the number of fiscal identification in Spain (NIE), to realize a contract of option, opening of bank account, emission of checks, notary, registry of property, cadastre etc…
Taxation: Optimize, always from the legal point of view, the payment of taxes in the purchase but also in subsequent years.
The third part is the most important. The verification of the legality of the property. After decades of permissiveness now the authorities of Majorca have decided to put an end to urban infractions. Making sure that the property my client is buying is 100 x 100 legal is essential before signing any paper. For reasons easy to imagine one cannot expect the seller or his agent to tell the truth. On the contrary, they often assure the buyer that if he does not immediately sign a contract, someone else will acquire the property before him.
As a buyer, don’t be fooled. In this process, haste is your greatest enemy. Do not accept advisors recommended by the real estate agent or the seller, get an independent advisor and ask him to check the legality of the property.
Urban illegality has led to a war between sellers, inspectors and buyers. In the midst of this chaos, even though I am a lawyer, I sometimes feel like a detective trying to make sure that the property my client is going to buy is legal.
