As is also the case in other parts of the island of Mallorca, before taking a step to buy a property in Sóller it is important to check the legality of the constructions and make sure that it will be possible to reform or rehabilitate them.

In addition, the rustic lands are in a high protection area, ANEI or ARIP, with some peculiar areas classified as “Horts i Tarongers”.

Buying process, as you can read in detail in this post, has different parts.

Before the purchase.

-Sóller it’s a paradise. Be sure that is the part of the paradise you would like to own. Don’t be in a hurry.

-Ask an independent adviser (lawyer) to check the status, the possibility of development, charges and the real ownership of the property. Whoever does that job has to work only for your interests. Don’t expect the seller or the agent (paid by the seller) to be looking out for your interests rather than their own.

-Make an offer

-Sign an Option Contract to allow you enough time to get your NIE number, wire the funds to Spain, get a mortgage if needed and allow time to the vendor to move out of the property

Purchase

-Sign the purchase deed in front of a Public Notary and pay the price. In the Spanish system in order to be registered the purchase deed has to be signed in front of the Notary. Soller notary or any other will be able to sign the deed and any real estate solicitor will be able to sign in your name if you can not be there.

What else a real estate solicitor may do after the Purchase in Soller?

When you sign the purchase deed, you become real owner, but there are a few pending issues to solve and your solicitor will do it for you.

a) Pay purchase taxes. As you may know, buying (and selling) means pay taxes.

b) Inscribe the property in the Land (Property) Registry, and in the Cadaster. You are the owner, but the purchase deed has to be duly registered. This not only applies in Soller, and your solicitor, as real estate expert will do it as soon taxes will be paid.

c) Change the supplies to your name. This is essential as if you don’t pay the supplies companies will cut your water and electricity.

d) Pay annual taxes. As owner you will pay land tax, garbage tax, model 210 tax is you are non resident and depending of the value of your assets in Sapain, also wealth tax.

BUYING PROPERTY IN ALARÓ
